Overview

The Department of Transport and Main Roads (TMR) is undertaking a sunset review of the Transport Infrastructure (Rail) Regulation 2017 (the Rail Regulation) to ensure it continues to meet the needs of Queenslanders. The Rail Regulation is part of a legislative framework that aims to ensure the safe and efficient operation of Queensland’s rail network by setting out rules and requirements for railways and rolling stock.

In Queensland, subordinate legislation is reviewed every 10 years to ensure it remains effective and relevant. The current Rail Regulation is due to expire on 1 September 2027 unless it is updated and remade.

The Rail Regulation helps TMR manage rail infrastructure through provisions for:

  • obligations of persons using railways or rolling stock
  • access to railway crossings and tracks
  • the removal and disposal of property
  • the use of vehicles on a railway
  • other miscellaneous matters (for example, signage).

TMR has been undertaking a sunset review of this Rail Regulation to assess the efficiency, effectiveness and ongoing need for it.

The next step is undertaking community and industry consultation to help determine if the Rail Regulation continues to meet the needs of Queensland's rail transport network and its users.

The consultation period closes 16 March 2026. Submissions received during this period will be considered as part of the review process.
